Occupational Orders
This is an Order which says who should live in your home and may exclude your partner from coming to the home. Notice must be given to your partner for the Court to make such an Order as clearly an Order that someone should leave their home is quite severe. In our experience, your partner is much more likely to oppose the making of an Occupation Order than the making of a Non-Molestation Order, so it is possible that you will need to give evidence as part of a trial. These are emergency short-term orders and if you and your partner own your home, then it is likely that in the long term decisions will need to be made regarding what happens to your home and whether it needs to be sold.
